By placing an order and confirming payment either on the Fire Publishing Limited website or via post or telephone, you agree to a contract with us to buy the goods and services in accordance with the following terms and conditions of sale along with our Privacy Policy.

Goods and Services
Fire Publishing Limited warrants that all goods for sale are of satisfactory quality when dispatched. Specifications of goods to be sold are intended only to give a general description and indication of the goods. We reserve the right to make any alterations in the description necessary to comply with any applicable legal requirements; and change the specification published on this website provided this does not materially affect the quality of the goods. In all other respects, and to the maximum extent permissible, Fire Publishing Limited makes no other warranties or promises about the goods, and any implied warranties are excluded to the fullest extent permitted by law.

Availability, prices and information
While every attempt is made to make sure stock is available, Fire Publishing Limited cannot be held responsible for unavailable goods, and all goods are offered for sale subject to availability. The price of the goods shall be the price listed on our website/magazine on the date of your order as confirmed by us, inclusive of VAT. All prices displayed on the website/magazine are quoted in UK Pounds Sterling and must be paid in full, including delivery charges.

Ordering
All orders are confirmed when you click on the “Place Ordering” button on the final checkout screen, as an offer by you to purchase the goods and services subject to these Terms. Orders and services may be rejected for any reason whatsoever prior to despatch of the goods. You are responsible for ensuring the accuracy of your order including delivery address and we shall supply you, subject to availability, with the quantity and specification of goods set out in your order. We shall confirm each order by e-mail but you are advised to print out the Web Confirmation Screen before closing the webpage. If we choose to accept your offer to purchase the goods, our written confirmation shall be our acceptance of the contract between us. In the event that we make a counter-offer to you, your written confirmation shall be your acceptance of the contract between us.

Payment
You may pay using Visa, Visa Debit, Visa Electron, MasterCard, Maestro, and American Express. Fire Publishing Limited does not offer any credit facilities, so we will not deliver goods to you if you do not pay for your order in full at the time of ordering. We use encryption software in an attempt to keep the information submitted by you secure. However, we cannot guarantee that any messages transmitted over the Internet, including those that include credit card details, will not be corrupted or intercepted by a third party. To the fullest extent permitted by law, Fire Publishing Limited excludes all liability for the integrity of any messages sent to or received from Fire Publishing Limited. The cardholder’s bank or card issuer will decide the exchange rate to charge the customer in their local currency.

Local Taxes
Some items sent abroad may be subject to local taxes dependent on country. These taxes are at the discretion of Customs & Excise for that particular country and are beyond the control of Fire Publishing Limited. In any event, it is the responsibility of the customer to pay such taxes to the Customs & Excise authority of the relevant country or countries and not to Fire Publishing Limited.

Data Protection
Fire Publishing Limited will process your personal data in accordance with, the Data Protection Act 1998 and our Privacy Policy. By sending Fire Publishing Limited any messages you consent to the processing of your personal data by Fire Publishing Limited using databases and spreadsheets for the purpose of processing your request. This may involve Fire Publishing Limited disclosing your details to regulatory bodies and/or third parties.

From time to time we may also notify you by post, telephone, e-mail or fax of other goods and/or services offered by Fire Publishing Limited or others, if you have chosen to opt in to our mailing list. Communications of a marketing nature that you receive as a result of being on this mailing list will give you the option to opt out of inclusion on the mailing list. You are free to request this at any time.

Delivery
Delivery shall be made to the delivery address supplied by you at the time of ordering. Risk of damage to or loss of the goods shall pass to you at the time of delivery. Ownership of the goods will pass to you only once we have received full payment of all sums due in respect of the goods, including delivery charges. Subject to your full payment of all sums due in respect of the goods, where an alternative delivery point is used according to instructions supplied by you at the time of ordering, ownership of the goods shall pass to you once the goods have been delivered, even if the goods have not been received by you in person.

We aim to dispatch all orders within 2 working days, with estimated delivery times below –
UK deliveries: 3-5 working days
EU deliveries: 5-7 working days
Rest of World: dependant on postal service provided in particular country.

Returns
Fire Publishing Limited wants you to be totally satisfied with our goods. Our warranty is subject to the following conditions: (i) the goods must be stored in appropriate conditions; if you do not store them in appropriate conditions we cannot be held responsible for faults or problems that arise as a result; (ii) any claim by you in respect of any shortages and/or defects in the goods must be notified to us by you within fourteen days of the delivery date; failure to notify us will deem you to have accepted the goods. Where you make a valid claim in respect of any shortages or defects and we are liable for the claim, we can at our option make up the shortages or replace the goods free of charge, or refund the price of the goods in question to you, but we shall have no further liability to you. If delivery is not refused and you do not notify Fire Publishing Limited accordingly, Fire Publishing Limited shall have no liability for any defects and you shall be bound to pay for the goods. Subject to the above, we are happy to issue a refund for unused and unmarked goods returned to us in their original packaging. All items must be returned with the sales invoice within 14 days of the purchase date.

Cancellations
If you are contracting as a consumer, you may cancel the order for goods at any time within seven working days, beginning on the day after you received the goods. Cancellation of orders will only be accepted if an email is received by Fire Publishing Limited within that seven day period. The e-mail or written notice must contain your order number, name and address. Fire Publishing Limited will confirm any cancellation by email and will repay you within 30 days from receipt of the returned goods in an unused and unmarked condition in their original packaging.

Limitation of Liability
The limit of our liability to you is restricted to the making up of any shortfall, replacement or refund of the price of the goods. We are not responsible to you to any greater extent and in particular we are not liable to you for any indirect or consequential loss which you may incur for whatever reason, as a consequence of our failure to comply with these terms and conditions. In particular, we will not be liable or responsible for any failure to perform, or delay in the performance of, any of our obligations under these Terms that is caused by events outside our reasonable control. This term does not operate to exclude or limit our liability in respect of death or personal injury caused by our negligence.

Transfer of Rights and Obligations
The contract between you and Fire Publishing Limited is binding on you and us and on our respective successors and assignees. You may not transfer, assign, charge or otherwise dispose of the contract, or any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of our responsibilities under these Terms at any time.

No Waiver
No waiver by us of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

Severability
If any of these Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

Entire Agreement
We intend to rely upon these Terms and any document expressly referred to in them (including emails) in relation to the subject matter of any contract. While we accept responsibility for statements and representations made by our duly authorised agents, please make sure you ask for any variations from these Terms to be confirmed in writing. Fire Publishing Limited reserves the right to revise and amend these Terms from time to time. You will be subject to the Terms in force at the time that you order goods from us.
